While she will want to convince the judge that the court has jurisdiction because no other state has jurisdiction under the jurisdictional tests of the UCCJEA or the UCCJA, whichever happens to be the applicable custody jurisdiction statute of the state of East Virginia, this should fail if she is candid with the court about the previous physical residence of the children in Germany; surely Germany would be considered the children's "home state."
